1. Acceptance of Terms
By accessing or using the Ovaview Media Monitoring platform (“Service”), operated by Ovaview Media Monitoring (“Ovaview”, “we”, “us”), you agree to be bound by these Terms of Use. If you do not agree to these terms, you may not access or use the Service. You must be at least 18 years of age to use this Service.
2. Description of Service
Ovaview provides media monitoring, analysis, and reporting services. This includes the collection, aggregation, and analysis of content published in newspapers, websites, radio broadcasts, television broadcasts, and social media platforms. The Service delivers curated news reports, sentiment analysis, competitor benchmarking, media presence reports, and digital archiving to registered subscribers.
3. Account Registration
To use the Service, you must register an account by providing accurate and complete information about yourself and your organisation. You are responsible for maintaining the confidentiality of your login credentials and for all activities that occur under your account. You agree to notify us immediately of any unauthorised use of your account.
4. Subscription and Billing
Access to the Service is provided on a subscription basis. Fees are billed in advance on a monthly or annual basis depending on the plan selected. All fees are non-refundable unless otherwise stated. Ovaview reserves the right to modify pricing with 30 days' notice to active subscribers.
5. Permitted Use
You agree to use the Service solely for lawful business purposes. You may not:
- Redistribute, resell, or sublicense the Service or its content to third parties without written consent
- Use automated systems (bots, scrapers) to extract data from the platform beyond normal usage
- Attempt to reverse-engineer, decompile, or disassemble any part of the Service
- Use the Service to infringe upon the intellectual property rights of others
- Share account credentials with unauthorised individuals
6. Intellectual Property
The Service, including its design, software, features, and branding, is owned by Ovaview and protected by applicable intellectual property laws. Media content delivered through the Service (articles, transcripts, clippings) remains the property of the original publishers. Your subscription grants you a limited, non-exclusive right to access such content for internal business use only.
7. Data and Privacy
Your use of the Service is also governed by our Privacy Policy. By using the Service, you consent to the collection and use of information as described in our Privacy Policy. We take reasonable measures to protect subscriber data but cannot guarantee absolute security.
8. Service Availability
We strive to maintain continuous availability of the Service but do not guarantee uninterrupted access. Scheduled maintenance, technical issues, or circumstances beyond our control may result in temporary disruptions. We will make reasonable efforts to notify subscribers of planned downtime in advance.
9. Termination
Either party may terminate the subscription by providing written notice. Ovaview may suspend or terminate your access immediately if you breach these Terms. Upon termination, your right to access the Service ceases and any stored data may be deleted after a reasonable retention period.
10. Limitation of Liability
To the maximum extent permitted by law, Ovaview shall not be liable for any indirect, incidental, special, or consequential damages arising from your use of the Service. Our total liability shall not exceed the fees paid by you in the 12 months preceding the claim.
11. Governing Law
These Terms shall be governed by and construed in accordance with the laws of the Republic of Ghana. Any disputes arising from these Terms shall be subject to the exclusive jurisdiction of the courts of Ghana.
